DEFINITIONS

In these Terms of Use:

“ACL” means the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

“Artisan Gin”, “we”, “our” or “us” means Artisan Gin Pty Ltd ACN 655 696 978, ABN 96 655 696 978.

“Authority” means any government, semi-governmental, statutory, administrative, fiscal or judicial body, department, commission, authority or tribunal.

“Buyer” means you, being a purchaser or potential purchaser of Goods from Artisan Gin through the Website.

“Claim” includes any action, suit, cause of action, arbitration, debt, cost, claim, demand, interest, verdict or judgment at law or in equity or arising under statute.

“Consumer Guarantee” means any consumer guarantee, condition, warranty or other right arising under the ACL or any other applicable law which cannot lawfully be excluded, restricted or modified.

“Goods” means the products or services offered or supplied by Artisan Gin and includes any product or service that is the subject of an order placed by the Buyer and accepted by Artisan Gin.

“GST” means goods and services tax imposed under A New Tax System (Goods and Services Tax) Act 1999 (Cth) and related legislation.

“Indirect or Consequential Loss” includes lost revenue, lost profits, lost business, lost opportunity, lost goodwill, loss of anticipated savings and incidental, indirect, consequential, special, economic or punitive damages, whether arising from breach of contract, negligence or otherwise.

“Intellectual Property” means any intellectual or industrial property owned by Artisan Gin or used in connection with its business, including without limitation:

  • graphics, logos, distinctive brand features, text, photographs, illustrations, icons and their arrangement;

  • patents, know-how, trade marks, service marks, copyright, inventions, designs, trade secrets and confidential information;

  • licences or rights to use or grant the use of any of the foregoing;

  • computer software and related licence agreements;

  • trade marks and business names, whether registered or unregistered;

  • registered domain names;

  • intellectual property created by employees, contractors or other third parties and vested in Artisan Gin by agreement; and

  • any other intellectual property or proprietary rights, whether registered or unregistered, used in connection with the business of Artisan Gin.

“Law” means all applicable statutes, ordinances, regulations, subordinate legislation, by-laws, standards, orders, directions, codes of practice and requirements of any Authority.

“Price” means the price payable for Goods as displayed or otherwise notified by Artisan Gin at the time an order is placed.

“Privacy Act” means the Privacy Act 1988 (Cth).

“Promotional Material” means material provided or published by Artisan Gin for the purpose of promoting the sale of Goods and includes Intellectual Property contained in that material.

“Website” means www.artisangin.com.au and any related pages operated by Artisan Gin.

“You” or “your” means the user of the Website and includes a Buyer.

INTERPRETATION

Unless the context otherwise requires:

  • references to a party include that party's executors, administrators, successors and permitted assigns;

  • references to a statute or Law include regulations and other instruments made under it and any amendment, consolidation, re-enactment or replacement;

  • words importing the singular include the plural and vice versa;

  • words importing a gender include all genders;

  • references to a person include an individual, firm, body corporate, association, government body or other entity;

  • where a word or phrase is given a defined meaning, other grammatical forms of that word or phrase have corresponding meanings; and

  • headings are for convenience only and do not affect interpretation.
